1. My doubt is whether the Workmen's Compensation Act is applicable to employees working in seasonal factories or not.
2. Whether compensation is paid by the employer or the government.
3. Employees covered under ESI can also avail of this Act's provisions or not.

Yes, the Workmen's Compensation Act, now known as the Employees' Compensation Act, is applicable to seasonal factories as well. Compensation is paid by the employer or the insurance company if the company has taken out insurance. Employees covered under ESIC cannot be covered under the Employees' Compensation Act.

Is WC/EC Policy Compulsory for Employers?

Is it compulsory or optional for employers to take a WC/EC policy for the insurance coverage of workers/employees?

Compensation Under WC Policy

Second question, if one takes a WC policy and shows an average salary of Rs 3500/-, under such a policy, when any of the workers meet with an accident and have an average salary of the last three months - Rs 5500/-, will the employer get compensation as per the actual salary (which is below the ceiling @Rs8000) or the average salary shown while issuing the WC policy?
