Can a foreign company employ people in India, directly without forming a subsidiary company of a branch in India? If yes which are the laws which govern these employments? And if not why?

In my opinion, the foreign company can set up an office in India and employ people. These employees would be governed by the Indian labor laws. However, a concrete reply in the matter can be given only after knowing all the facts of the case and looking at it from the angle of all the applicable laws. We can help you in the matter by giving you an opinion covering the aspects of all the laws that would govern the whole set-up. Please feel free to contact us.
