Dear All,

I would like to seek your help. In all organizations, there are three kinds of leaves granted: sick leave, casual leave, and earned/privilege leaves. If an employee quits the organization with a leave balance, are they entitled to encash their earned leaves? If yes, and the organization refuses to encash, what can be done in this case? Please let me know.

Dear Payal,

As per the Factories Act, it should be encashed, and if someone refuses to encash, you can file a case under the Payment of Wages Act. Some states' Shop and Establishment Acts do not have provisions for encashment.
