Dear All,
One of my college has resigned from his current job on 08-06-14 with an 15 days notice period and he will work here till 24-06-14.
Our Director is asking to serve the notice period of 30 days and also he has hold his May month's salary. He is saying that it will also be paid to him along with Full & Final Payment.
All you are requested to please suggest is this kind of last months salary hold is justified or not. Is any company has the right to hold the last month salary on the behalf of resignation & F & F payment?
Is my friend can knock the labor dept. door for the justification, as director is not listening our HR.

As the Director of Company is above HR, his decision shall be final & binding, and if you are
knocking the door of Labour Deptt, it is of no use.
However, as you are inviting suggestions from the HR members, please note my suggestion.
It is unfair and not justifiable to hold the May month's salary of your colleague by your Company.
At the same time, your colleague has to serve the notice period, as per his Appointment letter,
His salary for June could be paid after adjusting the balance notice period, if any,
as applicable to him - as per his Offer of Appointment letter.

Yes it is correct.
For eg: if u resign on 25th Jan u will not get salary for that month. Considering that u have a notice pd of 30 days..which would end on 24th Feb.
You will get Jan salary & Feb salary along with other pending amount (if any) as a part of FnF.
