I was worked for a company for 4 years and 11 Months (6 days a week). But at the time of leaving employer says that you are not eligible for gratuity.
I want to know, i am eligible for Gratuity or not . If yes than please tell with gov. Clause.

No, there is no break. Then please tell in brief with clouse. Because my employer says I am not eligible for gratuity. I want to show proof to the employer.

Law says 5 years continuous service.
One court case has decreed gratuity for a person who had 240 days service in last year of service.
But law says 5 years.
Probably you may have to go labour officer or court.
