Due to conflicts between Ahmedabad and Mumbai management, the Board of Directors decided to close the entire Ahmedabad operations. Now, management wants the employees to sign some fake agreements. When the employees refused to sign the agreement, the company withheld all the employees' PF withdrawal forms.

Kindly advise on how we can retrieve the amount from the PF office.

19) What is the procedure to be followed by the member if the employer is not attesting his claim forms?

It is the duty of the employer under the Act & Scheme to help Employees' Provident Fund organization to settle the Provident Fund dues of his employees. He has to complete the prescribed application within 5 days of receipt [para 72(5)] forms & hand it over to the member when he leaves the service. When a member finds it difficult to get the form attested by the employer, he can get the attestation of any of the following officers & send it to the Provident Fund office.

- Manager of a bank.
- Any gazetted officer.
- Member of the Central Board of Trustees/committee/Regional Committee (Employees' Provident Fund Organization).
- Magistrate/Post/Sub Post Master/President of Village Panchayat/Notary Public.

Dear friend,

Our friend has explained things very nicely. Besides this, the employer refuses to sign the withdrawal form. You can submit directly to the PF office with a letter stating that the employer is refusing to sign the PF form and unnecessarily harassing you. The PF authorities will send that form to the employer who is bound to sign and return the same.

Hi,

Simply fill out the two forms available on the website (19&10 c). Complete all sections and have the form signed by the bank manager from a nationalized bank where you have a savings account. Then, deposit the completed forms with the PF department.
