Dear Sir,

If an employee takes leave (without pay) on Saturday and reports for duty on Monday, is it fair to treat Sunday (a weekly holiday) as leave and deduct 2 days' salary from pay? Is it right as per Labour Laws?

Dear Mr. Seshadri,

No, you can't do it, and it is wrong. Also, if the employee is on loss of pay for both Saturday and Monday, then Sunday is also going to be a loss of pay. In the case of CL and SL, intervening holidays or weekly offs are also a part of leave, but in the case of EL / PL - No.

Dear Seshadri,

It is totally wrong and unfair to follow such a leave policy. Most of the org's leave policy is as follows:

1) If you take leave on Friday and Saturday and report on Monday, then there will be two days of leave. (Sunday excluded).
2) If you take leave on Saturday, Monday, and report on Tuesday, then there will be a 3-day leave. Sunday will be included as a leave.

If anybody fills up EL/PL for Saturday and Monday, then there are only two leaves. You should mark Sunday as a W-Off. If anybody fills up CL/SL for the same day, then it should be marked as three leaves.

Dear All,

Most of the people are correct. Sunday will be treated as a holiday. However, for some shift workers whose weekly off is on a day other than Sunday, that day will be considered their off day. If the management has any specific leave policy, it may vary. According to labor laws, "Any person continuously working six days, the seventh day will be treated as the weekly off."

How many days work in a week is required for getting a week off , as far as sunday deduction bitween saturday and monday sunday will not be trated as leave.

Anyone working continuously for 6 days, the next day is a holiday. It depends on the management to decide which day it should be. However, once the day is declared as the weekly off, it does not matter whether the person is present the day before or after.

If you are paying for an off-day, it should be excluded from leave. It is a fundamental rule for leave, "'If the leave begins or terminates on a holiday or a close day (off-day), such days are excluded from the calculation of leave.'"
