Hi friends,

I would like to know if there is an ILO convention on 13th-month pay. Is it a negotiated and statutory provision in ILO-affiliated countries or a practice that is generally accepted industry-wide? I have been searching with nothing but the Filipino law in support of it. I would be grateful for any assistance.

There are no ILO Conventions on 13th-month payment. You will find conventions and laws on minimum wages, but not the 13th-month payment. In most countries, including Malaysia where I hail from, a bonus is either in the contract of employment, a discretionary payment by employers, or is negotiated during the process of collective bargaining.
