In our organization, we have the custom of giving increment letters every year once the individual's appraisal is over. Sometimes, the staff who are not happy with the increment being given refuse to acknowledge the increment letter. Please note that we credit the salary through the bank, and the situation has not arisen when employees who are refusing to acknowledge return the increased portion of their salary.
Under such circumstances, I personally feel that we need to get the acknowledgment as well. If the employee is sure to return the excess salary, we can very well take it back, and no increment effect will be given to him during that year. Is this correct, or are there any legal impediments to this? Please clarify.

I personally feel you are right in your opinion. A person who is refusing to acknowledge his increment letter has no right to accept the increment given to him also. If the employee accepts the increment, then he or she is bound to acknowledge the letter as well. If he doesn't, then it may be assumed that he or she is not accepting the increment given to him. The matter is not at all acceptable. Please rectify the matter on an immediate basis. Whatever is happening is not legally right.
NB: As far as your company is concerned, you need not worry too much as you have enough reasons to prove that the employee has accepted the increment. But it's better to keep things in order rather than letting things happen. Never set a bad precedence.

Dear, it is a disciplinary case. If someone refuses to accept the communication issued by management, it is considered misconduct, which is defined in the model standing orders as well as the certified standing orders of the company. Tomorrow, he will refuse any of your letters. In my view, he should not be given any increment and disciplinary action should be taken against him.
