Hi All,

I have a concern that I would like to put before the forum for suitable suggestions. An employee who was associated with another company and had resigned from there. Although he was a member of the PF with the company, after resigning, he did not close the account, and hence his PF contribution still lies with the PF Dept. Now, after 8 months of resigning from the company, he joins a new organization. I seek your inputs on whether his earlier PF contribution will be transferred to the new PF account since nothing has been contributed to it in the last 8 months, or if he has to close that account and request the withdrawal of PF funds.

Please suggest for the sake of my knowledge.

Thanks,
Piyush

Dear Piyush,

You have both options open, but I suggest transferring your old account to the new one. The advantage is that you will receive continuous service and be eligible for pension benefits (if you have 10 years of service).

Thank you very much.

Now, my another concern is that the earlier PF A/c was based in Hyderabad and now the present one will be based in Lucknow. What are all the formalities one needs to do in order to get it transferred to the new A/c? Please suggest.

Please have Form 13 filled out by the employee and then forward it to RPFC, Hyderabad through the current employer so that the accumulations from the old account in Hyderabad can be transferred to the new account in Lucknow.

Since the PF is valued by those currently employed for their future, they should be advised to transfer the PF amount.

Procedure to Transfer the PF Amount:

Step 1: You can collect Form 13 from your HR/Personnel department of your present employer or download the withdrawal form in Form 13 from the [EPFO website](http://www.epfindia.nic.in).

Step 2: You can fill up all the details about your PF account with the previous employer, including the name & address of the previous employer, and sign the form.

Step 3: Hand over the form in triplicate to your present employer's HR department.

Dear Mr. Malik,

I have been seeing your posts of late and have a query that I would like to request you to answer for me. In case an employee leaves an organization and he did not settle his account, i.e., he did not pay the notice period amount, then in that case, can he get the PF forms cleared from the company? If the company refuses to do so, can the employee take some legal course of action or escalate it to the PF authorities? Also, since the employee has worked there for 16 months, will he get the employer contribution too?

Kindly advise.

Thanks
