I was working with a renowned educational institution for the last two and a half years on a contract basis. However, my contract was terminated by them on December 31, 2008. Surprisingly, they stopped my salary for the month of December. Despite my numerous calls and emails to the HR department, they have not provided me with a clear timeline for when my salary will be released. I have also submitted the PF form to withdraw my money. It has been over a month since then, and I am at a loss for what to do next. I obtained my "No Dues" clearances on January 1, 2009. Can anybody advise me on this matter, please?

dear you can file a case under payment of wages act with labour authorities.but i will suggest to send a legal notice to institution before filing a case . tks j s malik

Dear friend,
Please send a letter to the concerned person mentioning the issue and request them to settle your accounts. If the concerned person fails to reply or settle your accounts, then write a letter to the head/chairman or the highest authority of the institution. If even they also fail to take the necessary action, you can resort to legal action. However, the legal process requires a lot of time and effort and is also a bit costly.

I don't understand how you received the no dues certificate when you have not received your whole salary from the organization. You should not have accepted it. A 'no dues certificate is signed when the organization clears all your dues.' Please talk to them and settle things.

I think Gladys has interpreted 'no dues certificate' in a different way. It is after getting the No Due Certificate signed by the departmental heads that settlement will be made.
Being an employee of an educational institution, Bipin may not get recourse in Labour Laws. However, 'a reputed education institute' is not supposed to delay final settlement.

Hi there,
In case you send a letter to the concerned person requesting clearance of your settlement amount, it is advisable to send it via Registered Post. This will provide support to some extent in the future if you need to file a case. If there is no action taken on your request, you can resend it up to three times before proceeding with legal action. Despite the existence of strong Labor Laws, such instances continue to occur across the country.
