I was working with an educational institute and was associated for more than 6.5 years. I have left the organization on 1st May 2008. I was released, and I am in the process of getting the PF. However, the company has not cleared my Gratuity, Leave Encashment, and some conveyance amount, which totals around Rs. 1.5 lacs. How should I approach and get the claim? Please help me in this regard. It was not mentioned in the company rule book that gratuity would be given to the employees. However, I have completed 6.5 years of service there. Please help me in this regard.

Gratuity is a central act; it is applicable to all industries having 10 or more employees. If the employer is unwilling to clear your dues, please prepare a full and final statement at your end and send it via registered mail with acknowledgment due. Hopefully, this will resolve the issue.

Arup, As per arup guidelines Gratuity is applicable to all industry. After this u can go Labour Office with your Appointment Letter. They will take care. Regards,
