I have worked for a French-based company in Noida for about 1.5 years. When I left, I didn't have a great relationship with the HR.

Though there weren't many issues, she seems to be taking it too far and now refusing to assist me in the withdrawal of my PF amount. Is it necessary to have the PF withdrawal form signed by HR? The other person is also not going to sign as she and the company director have a lot in common 😢.

Is there any other way to get my PF money without the intervention of my previous employer? I know about the legal suits, but I don't want to go that way unless necessary.

It is mandatory that every employer has to sign the forms for withdrawal of PF failing, which we can directly make a letter to PF authorities for not complying with the procedure by the companies. I suggest that you get the form, fill it, and send it by RPAD to your company so that it may be evidence for future correspondence. Then, after some time, as I advised earlier, do that. I hope that you could understand me.

If your present employer is not signing the withdrawal form, then you can get the form signed by another A Grade official, the authentic designation which will be considered by the PF Department mentioned on the back leaf of the withdrawal form.

As per the present scenario, I suggest that you must visit the PF office and meet with the PR officer. He/she will help you understand the necessary steps required in this matter. Nowadays, you also have to submit the SSN form along with your withdrawal form, duly signed by the employer.

I am not sure how to confirm if they have sent my resignation details to the PF department. I believe I need to visit the PF office.

Another thing to consider is that my PF contributions were being deposited in Noida. Should I contact the Noida PF office, or can I also visit another PF office, such as the one in Gurgaon where I reside?

Dear friend,

Please note that if your company fulfills all the monthly challan and return of PF, and they have sent the resignation information to the PF department (Form 10), you can withdraw PF without the signature of the HR manager or owner of the company. You can attach a copy of the bank statement showing your name and address, and have it attested by the bank manager or any gazetted officer, and apply to the department. It will take approximately 2 months to credit in your account.

Yes, I do remember the authorized signatories. There were actually two people who signed; one was the director (she has left the company a long time back), and the other is HR (I don't expect her to sign my PF documents; I am sure she is not going to cooperate).

Nope, I don't think so. :D

I think there should be a way to get my money back. In any case, legal action is always an option. Fundamentally and legally, an employer cannot be the reason for this becoming a gated issue. I think I should go to the Noida PF office and talk to the authorized person there.

You can get your claim attested with the bank manager, where you have account and send it straight to the local PF office in which your company contributes PF
