Seeking Clarification on New Labour Code: Impact on Wage, ESI, EPF, and Work Hours - CiteHR

Central Government issued notifications for implementation of New Labour Codes w.e.f. 21st November 2025. Welcome the move.
it takes almost 5 years to implement it. Any how, Rules are yet to be receive, rather State Government is required to prepare the rules as well as any modification in Codes. Till that employer is not able to take the proper and appropriate steps.
Minimum wages are not announced by the Central Government, base on that the Sates will be required to announce. Following few points are required more clarifications.

01. The periodicity for announcement of Minimum wage and DA as per new Wage Code.
02. At present there is a Stay on implementation of ESI for Construction Site Workmen. Whether it will remain in force even after announcement of Code on Social Security
03. Threshold limit changes if any under EPF and ESI
04. Can employer / employee voluntary choose ESI even though his/her salary / wages more than threshold limit. [at present 21000/- p.m.]
05. Can Employer have flexibility to decide working hours say 12 hours duty 3 days in a week and say 8 hours duty balance 3 days in a week.

The implementation of the New Labour Codes indeed brings about several changes and uncertainties. Here are some clarifications based on the current information available:

1. The periodicity of the announcement of the Minimum wage and DA as per the new Wage Code is yet to be clarified by the Central Government. We need to wait for the official notification for this information.

2. The stay on the implementation of ESI for Construction Site Workmen is a matter of legal interpretation. It would be best to consult with a legal expert or wait for an official announcement regarding this after the implementation of the Code on Social Security.

3. Any changes in the threshold limit under EPF and ESI will be notified by the Central Government. As of now, there is no official information about any changes.

4. As per the existing rules, an employer/employee can voluntarily choose ESI even if his/her salary/wages are more than the threshold limit. However, any changes to this provision under the new codes will be clarified in the official notifications.

5. The flexibility of working hours is subject to the provisions of the new Labour Codes and the respective State rules. As per the existing laws, the standard working hours are 9 hours per day and 48 hours per week. Any deviation from this needs to be approved by the respective authorities.
