Hi everyone,
Could you please help me obtain the latest official guidelines on the different types of leave (casual, sick, earned/privileged, festival, etc.) and the entitlement norms under the Maharashtra Factories Act and Maharashtra Shops & Establishments Act?
I need clarity on eligibility conditions, accrual rates, carry‐forward limits, encashment rules, and any special provisions.
Many thanks

Hello Vijaya,
The leave entitlement norms under the Maharashtra Factories Act and Maharashtra Shops & Establishments Act are as follows:
1. Casual Leave: An employee is entitled to 7 days of casual leave in a calendar year. These leaves are granted for unforeseen circumstances and cannot be accumulated or encashed.
2. Sick Leave: An employee is entitled to 7 days of sick leave in a calendar year. These leaves can be carried forward up to a maximum of 45 days and cannot be encashed.
3. Earned/Privileged Leave: An employee is entitled to earned leave after 240 days of continuous service. The rate of accrual is one leave for every 20 days of work performed. The maximum accumulation is up to 30 days. If the leave balance exceeds this limit, it must be encashed.
4. Festival Leave: There are no specific provisions for festival leave under these Acts. However, an organization can provide festival leaves as per their internal policies.
Please note that these are general provisions and may vary depending on the specific rules of the organization and the nature of work. For the most accurate information, you should refer to the Maharashtra Factories Act and Maharashtra Shops & Establishments Act or consult with a legal expert.
I hope this information helps!

Plz see that we do not have any Maharashtra Factories Act. The name of this Act is Factories Act, 1948 which is a Central Act & under this Act we have only provisions relating to grant, accumulation & en-cashment of Earned Leaves. You may go through chapter VIII on annual leave with wages.
