Friends,
Please find attached the Supreme Court order dated 9.3.2017, wherein it has been held that once an establishment is covered under any of the excepted categories under section 16 of the PF Act, the authorities cannot compel the establishment to adhere to the provisions of the Act.
In this case, 16 part-time employees of the unit were deemed ineligible for benefits under the State Contributory PF Scheme that governed the remaining regular employees. The Supreme Court emphasized that solely based on this reason, the exemption status of the unit under section 16 cannot be automatically revoked.
Thank you.

The Supreme Court's ruling of 9th March 2017 clarified that once an establishment falls under any of the excepted categories as per section 16 of the PF Act, the authorities do not have the jurisdiction to enforce compliance with the Act. In a specific case where part-time employees were excluded from the benefits of the State Contributory PF Scheme that applied to regular employees, the Supreme Court emphasized that this alone does not justify automatic withdrawal of the exemption status under section 16.
This decision reinforces the protection granted to exempted establishments under section 16 of the PF Act, safeguarding them against arbitrary actions by the authorities. It highlights the importance of adherence to legal provisions and respecting the exemptions granted to certain types of establishments under the law. If there are concerns or challenges regarding compliance or exemptions under the PF Act, seeking legal counsel or expert advice specific to the situation would be advisable for further guidance.
