The Employees' Compensation Act shall not apply to all employees in commercial establishments. It shall apply to all employees in factory-type establishments, but when it comes to shops and commercial establishments, only selected employees as described in Schedule II of the Act will be covered. Schedule II is attached for your perusal.

Madhu is Right As per the current legislation, It is covered for the industries or the employees who are engaged in the scheduled industries & the same is not applicable for rest of the industries

  • It is certainly a question of law. An elevator is equipment installed within an establishment. Any injury caused due to its malfunction should be treated as an accident while in connection with employment only. The employer who has installed the equipment is responsible to compensate for the loss caused to the employees. But that may not fall under the Employees' Compensation Act. Obviously, if the elevator is within a factory, mine, or dock, it will come under the scope of accidents under the Act. But when it is under a shop or commercial establishment, it will come under other compensation. The employer can claim compensation from the manufacturer of the elevator/equipment failure or malfunctioning of which has caused the accident. This is what I feel right now. But I will get back with more thoughts on the subject soon.
