Dear Experts,

I have a doubt regarding the date of exit of our former employee. As per attendance, he worked 9.5 days in the month of September (present until the 23rd day, while NCP's days in ECR are 21 days).

So, may I know what will be his leaving date? Please confirm.

Thanks & Regards,
R.K. Chauhan

His last worked day in your concern is his date of exit in EPF

If he was paid a salary for 9.5 days, how can the NCPs be 21 days when the total number of days is 30 in September 2023?

Handling Overlapping Dates of Exit and Joining

In the case of an employee joining another company on the day after being relieved from your company, the date of joining in the new company will overlap with the date of exit from your company. If he was present on the 10th of September for part of the day and wages were paid for that part, it is acceptable to mark him as exiting on the 11th of September, provided he has not joined the other company on the 11th. If he has joined the other company on the 11th, you will have to mark his exit on the 10th itself.

@Madhu TK Sir, He worked only 9.5 days (total working days is 9.5 days) and did not join any other company. Thanks & Regards R.K. Chauhan

Then mark the exit on the 11th day. With that 10 days working will be accounted for him as paid days for which contribution will be payable and the remaining 20 will be the NCP days.
