Hi, Hope you had rendered your services as regular employee and there is no break-in-service in the middle. If so you are eligible for Gratuity.

As per the Payment of Gratuity (PG) Act, you are entitled to gratuity if you have 5 years of continuous service, regardless of your nature of job (regular or otherwise), designation, etc.
If the employer refuses to pay gratuity, you can approach the controlling authority under the PG Act to claim your gratuity.
