Dear all, I have a doubt about leaves. How many leaves can I apply for in a month? For example, I haven't used any leaves yet (August), but I would like to apply for all of them this month. Is this possible? Am I eligible for all the leaves this month? Please explain the issue mentioned above!

Annual Leave Under the Factories Act
As per the Factories Act, there is only one type of leave, which is annual leave. There are conditions to earn the annual leave. The worker should work for 240 days in the previous year to earn leave in the current year. To qualify for the 240 days, annual leave enjoyed in the previous year, lay off, in the case of female workers, maternity leave, etc., need to be considered. However, the annual leave earned will be based on the actual days worked divided by 20. Any fraction of half a day or more shall be treated as one full day leave.
Sick Leave and Organizational Policies
Sick leave is usually what workers enjoy from ESIC. Moreover, there may be a leave policy of the organization. Some provisions may be in SO, may be by union(s) negotiation - there is casual leave, sick leave specifically for workers not covered under ESIC, etc.

@V Manikanta, I think there is either confusion in your company regarding leave rules or the employer is not following standard procedures. Since you have not specified the size of the company, it is unclear if standing orders are applicable. I assume it is a factory.

1. You are entitled to 1 day of leave for every 20 days worked in the previous calendar year.
2. This leave will accrue (be available) on the 1st of January of the following year, and you can utilize them as you wish, subject to the HR Policy on how leaves are applied and approved.
3. If you do not utilize the leave during the year, it can be carried forward (to some extent and under specific circumstances) to the next year, again, subject to the rules.
