My company is asking me to recover a pay recovery amount after sacking me, which is almost my 2 months' salary.

Due to my ill health during the time of Covid, I was terminated from my job.

Notice Pay Recovery Applicability

How can notice pay recovery be applicable to my termination? Also, they didn't inform me that they terminated me by any message or call. A simple email was sent, and my termination letter went to the wrong address.

Next Steps

What should we do now? Should I initiate legal action against them as the company officials are ignoring my calls and emails?

Dear Colleague, termination during COVID sickness is not admissible legally or morally. No legal case will stand if such actions are taken by an employer; it is a very cruel act. If someone does this, it is completely wrong.

No notice pay recovery is applicable or admissible in such cases. You should provide a suitable reply through your advocate to the company so that they withdraw the notice pay recovery intimation.

Focus on finding new employment rather than pursuing other legal cases, apart from defending against the notice pay recovery action by the employer, as it is a futile and drawn-out process. Concentrate on your job search and move forward towards a new life that will be a better place for you instead of wasting energy on non-constructive activities. God bless!
