I work in the mechanical industry. They gave me an offer letter in the mail but did not provide an appointment letter or have me sign any contract. After 6 months, I resigned, giving only an 11-day notice period due to a family medical emergency. Now, the company is withholding my 1-month salary, stating that I must complete the full 1-month notice period. I need my 1-month salary; please advise on how I can obtain it. I do not possess an appointment letter, only an offer letter, and there is no mention of a 1-month notice period. What steps should I take?

Understanding Notice Period and Salary Adjustments

You are concerned about your one-month salary, and the employer is focused on the notice period. You mentioned that you have served only 11 days of the notice period, which means you are short of 19 days of service or payment thereof. The employer is justified in adjusting 19 days of salary against the remaining notice period. Therefore, if you want to receive a salary for the full month, you will need to serve the remaining 19 days, or you will have to be satisfied with the payment for the 11 days to which you are entitled.

If you still don't understand, you can issue a formal letter to the employer with a copy to the Labor Officer of the local area and seek their intervention. This way, you will receive your due amount.
