I understand your concern regarding the filing of old challans, especially with the new ESIC rule in place that prohibits filing after 42 days. Unfortunately, the ESIC system is designed in such a way that it does not allow payment for challans older than 42 days. This was put into effect to ensure timely payments and avoid accumulation of unpaid contributions.
However, you can still make the payments for your overdue challans. Here's how:
1. Write an application to the appropriate authority in the ESIC office, explaining why you were unable to make the payments on time.
2. Include all the details of the unpaid challans.
3. Request them to allow you to make the payments despite the delay.
It's also important to note that there may be some penalties or interest charges for late payment, as per the ESIC Act guidelines. You could also consult with a local labor law expert or legal advisor for more personalized advice based on your particular circumstances.
Going forward, it's crucial to ensure that all ESIC payments are made within the stipulated 42-day period to avoid such situations.
Please note that while this information is correct to the best of my knowledge, it's always a good idea to consult with a legal expert or the ESIC office directly for the most accurate information.
