Dear HR Seniors, I need your opinion on the matters below.

Employee Termination and PF Claim Issue

One of our employees joined our organization as a sales manager on 18th Oct. 2019, and he was terminated on 6th Nov. 2019 due to bad behavior. His PF amount is pending from his previous organization, and he is trying to withdraw his PF claims. The PF department asked us for KYC approval, which we provided, and the same is reflected on our portal.

Now, he claims that we rejected his transfer claim twice. However, upon checking our portal, I did not find any pending approvals or rejected claims.

He is now threatening me, stating that he will pursue legal action against me and lodge an FIR. Please advise on how to clear myself of these accusations.

Hi,

No need to worry. PF is statutory, and the employer has no right to hold it, either transfer or claim. Even if he addresses the issue legally, your employer will prove that nothing was pending from his end. Please ignore such calls, and if he submits any written complaint, reply to it stating that nothing is pending at the employer's end.
