Tamil Nadu Shops & Establishment Act

We are running a showroom with 3 staff members and 2 carpenters. The holidays listed for 2012 are 12 days. Staff leave is allowed for 24 days per year. For carpenters, along with the holidays, how many days of leave can be allotted?

That was valuable information. As per the TN Shops & Establishment Act, the EL entitlement is 12 days, which can be accumulated to 24 days. Please let me know if my leave exceeds 24 days, for example, 28 days in the 3rd year of my service. Will the company have to pay for the remaining 4 days, or will they be lapsed? Kindly also specify the rule or section where I can find this information in the TN Shops & Establishment Act.

You can accumulate earned leave (EL) for a maximum of 90 days. Today's scenario varies from company to company. Some companies will credit 30 days in advance at the start of the year and will carry forward 15 days to the next year if the leave balance is more than 15 days. Any other remaining leave will lapse. In the following year, 30 days will be added to the 15 days.

Leave Accumulation Details

30 days of earned leave is derived from 2.5 days per month. For more details on the rules, please refer to the first page of the TN S & E Act manual soft copy.

    You can apply form VA to the respective DIL/LI in your circle. Since you are an online retailer, your warehouse has to be registered only under the Shops and Establishment Act.

    Definition of "Shop"

    "Shop" means any premises where goods are sold either by retail or wholesale, or where services are rendered to customers. It includes an office, a storeroom, godown, warehouse, or workplace used in connection with such trade or business. However, it does not include a factory or a commercial establishment.

    Reporting Requirements Under the Shop & Establishment Act

    If any institution, which is registered under the "Shop & Establishment Act" of the concerned state, experiences an accident involving one of its employees—(i) causing an injury, such as a fracture or loss of limb, or (ii) resulting in a fatality—then in such a case, which form needs to be filled under the said act and submitted to which authority? What are the employer's duties regarding reporting to the statutory organization, whether state or central government?

    In case you have not got clarity on this registration part in Tamil Nadu, we would like to clarify that it is not required to obtain a registration certificate under the TN Shops & Establishment Act, and there are no official formalities to do so. Instead, each establishment must obtain formal approval from the authority under the TN Industrial Establishments (National & Festival Holidays) Act, 1958. This approval is known as the "Festival Holidays Approval."

    No provision is made for the number of employees under the Tamil Nadu Shops and Establishment Act. This Act applies even if you have only one employee in your establishment. However, you may be exempt from submitting returns and maintaining registers based on your establishment's employee count. There is a provision in "The Labour Laws (Exemption from furnishing Returns and Maintaining Registers by Certain Establishments) Act, 1988."

    Hi,

    First of all, please note that there is no S&E Registration Certificate under the TN Shops & Establishments Act. However, there is a process for obtaining approval in Form III under the TN Industrial Establishments (National & Festival Holidays) Act. This approval will be permanent unless there are changes in the holidays list.
