Hi, can you please let me know, "Is the PF department liable to pay the amount to the concerned employee?"

1. If a company deducts PF contributions from the salary but does not deposit them for more than 2 years.
2. In the meantime, the company goes under liquidation without depositing the contributions.

Hi,

I came across the same case sometime back. Deducting PF and not depositing it in the PF account is an unethical practice. First of all, you need to understand whether your company is eligible to have a PF account, meaning whether you have 20 or more employees working in your company. If yes, and they have been deducting PF for the last two years but not depositing it, you should question your employer. Maybe they have a trust. If nothing works, you may visit the nearest PF office or the Regional PF Commissioner's office in your town, or visit www.epfindia.org and report the issue online. You need to write a complaint about the unethical practice adopted by your employer.

Hi Basudeva,

I would like to tell you in detail about my case. I worked with a company for 5 years. The company was covered and allotted a code number by the PF department. They deducted PF from employees' salaries for the whole period but only deposited it for one year.

PF inspections were conducted, and they were prosecuted under 7A.

After leaving the organization, I applied for withdrawal and received only one year's worth. Meanwhile, the company went into liquidation.

I filed a case against the PF department for underpayment, and the ruling was in my favor. The PF department appealed in the state consumer forum against the decision.

I am currently pursuing the matter in the state forum.

Please provide me with your legal opinion regarding this situation, as the money of all workers has been affected due to the PF department's non-compliance. If the PF department had taken legal action earlier, they could have recovered the amount from the organization.

At this stage, is the PF department liable to pay me the balance amount for the remaining 4 years?

Please also assist me in obtaining any court decisions or notifications available on this matter.

Dear Sir,

I worked for Nagarjuna Construction Company Ltd at the Delhi Regional Office as a planning engineer. I had submitted my resignation long back and fulfilled all the formalities to withdraw the P.F., but until now, the PF amount has not been credited. I have already sent an email to our HR manager, but I have not received a reply. Kindly do the needful. I have also emailed the PF Commission Board in Hyderabad and Delhi, but no action has been taken yet. Please look into the matter.
