I resigned from my current organization in August after serving only a 45-day notice period out of the required 90 days. Due to a leg injury, I discussed with management that I am unable to continue the notice period and needed to go on leave for treatment. I have been undergoing treatment for the past two months, and I am currently in the third month. The company is now asking me to come back and complete the remaining notice period. However, I have explained that I am still undergoing treatment and unable to return at this time. I have requested a pay-out option for the remaining notice period, but they are refusing and threatening to label me as absconding from the organization. I have provided proper medical documentation showing that I needed to undergo leg surgery, which has been postponed due to personal issues, and I am currently in the process of receiving medical treatment. Despite this, they are not accepting my situation. Can you please advise on how I can obtain my relieving and experience letter, as well as my PF money?

Send them a registered post explaining everything and keep a record. Request for PF to cover medical expenses separately. Inform them that once recovered, we will discuss the balance of the notice period. Once recovered, convince and collect the relieving and experience letter; there is no other way to go.

Apply for medical leave during the notice period as medical leave is allowed. If you have no leave balance, there will be a loss of pay. You cannot be treated as absconding as you went on medical leave during the remaining notice period days and submitted all relevant medical treatment documents.
PF transfer can be done once you join a new employer and apply online for transfer. The new employer will link your new PF account with the previous PF account using the UAN number.
