What should we do if the state labour department asks us to take the license from them? The cement industry is directly controlled by the Centre, and we are located in a central provision. Can we become exempt, or does any particular act mention this? Please help and suggest.

Cement Industry is a notified industry under the Industries (Development and Regulation) Act, 1951. Therefore, in any such Controlled Industry, the State Authorities can enforce the provisions of licensing, inspection, etc., only with respect to those Central Enactments exclusively administered or enforced by the State Governments. I think you should specifically state what labor license is insisted by the State Government people.

Licensing Requirements for Cement Packing Plant in Kerala
Our cement packing plant is located in Kerala, where administrative rights are with the central government under the Major Port Act. We have obtained a Contract Labour License and an Interstate Migrant Workmen License from the central government. However, the state labor department is insisting that we also obtain these licenses from the state. Upon further investigation, we discovered the following:
- The Central Government issued notification No. S.O. 826 (E), dated 8th December 1977, notifying that the powers exercisable by the Government of India under the Industrial Disputes Act, 1947, in relation to the cement industry shall also be exercisable by the State Governments (except Mines).
We are unsure whether the state government has issued any notifications related to the above. Could you please guide us on how to determine if the state government has issued any relevant notifications?
