Hello Everyone, I am looking for a policy document: Allowing to do freelance while doing a full time job in any private sector with certain terms and conditions.

Dear friend,
Your query is incomplete. Please confirm what your background is, your designation, and the nature of your industry. Secondly, you have not specified whether the query is from the employer's point of view or the employee's point of view. Thirdly, what kind of job does the freelancer want to do? Will the freelancer take up a completely different job, or might they work for a competitor as well?
Most companies impose a ban on employees taking up any additional jobs, whether regular or as freelancers, beyond their current employment. A clause to this effect is usually inserted in the appointment letter. Your query seems to contradict this clause. Please clarify why you feel the need to do so.
Thanks,
Dinesh Divekar

Hello Dinesh,
Thank you for the reply. I am working as an HR professional in an IT services startup company. I am looking for this document from an employer's point of view. The freelancing work includes coding-related tasks, which involve complete technical work. I am aware that some companies do not allow their employees to do freelancing due to security issues. However, if a company wishes to permit it, what would be the complete terms and conditions that need to be signed by the employer? Please let me know if you need any more clarification regarding the question.

Dear friend,
If your company is accommodating of freelancing by employees, you may consider including a clause to this effect in the appointment letter. However, permission to engage in work outside of regular working hours cannot be absolute and will have certain limitations. These limitations may revolve around the disclosure of work-related information and any potential conflicts with the primary job due to freelancing. Additionally, the concerned employee must declare where they will be working, the type of work they will be doing. Your company should reserve the right to grant permission.
Thanks,

How will the company supervise the off-time work of employees? It introduces a complexity in work that is avoidable. Proving that an employee used or did not use expertise gained by working on products/coding of the company in freelancing are aspects that need deep consideration.
What is the background for allowing freelancing by employees? If an employee is going to be busy during non-working hours also working, what will the impact be on his health and company work? The company has to think twice before getting into this policy; however, well-designed.

The idea of allowing employees to take up additional jobs as freelancers is good, giving them an extra edge of financial empowerment. However, as expressed in the above limitations, I have a few points that you may consider while drafting the Policy:
- Category of jobs to be taken up as freelancers
- Disclosure of the jobs to be undertaken with the duration and amount
- What constitutes a breach of office information, with examples and its legal implications
- New idea: a percentage of freelancing income to be donated to a list of NGOs authorized by you/office in the form of a cheque
