Understanding Break in Service Certificates under EPF & MP Act 1952
First of all, there is no prescribed "Break in Service Certificate" under the EPF & MP Act 1952.
As far as the PF Account is concerned, there is no relevance of a break in service. Whatever amount is accumulated in your account, you are liable to receive it with interest. An inoperative account is a separate issue.
Relevance in Pension Accounts
However, in the Pension Account, a break in service is a relevant factor. In Pension Form 10C, the employer has to write non-contributory service at the end of the form. Similarly, in Form 10D, the employer must certify the non-contributory service during the past 12 months from the date of leaving the service.
There is no need for a separate certificate of break in service. However, some offices still insist on such a separate certificate, and we comply. We do not engage in confrontation with the department.
I have developed a certificate in Word, which is attached herewith. You can use the same or the one given in Excel by our esteemed member, Mr. Janardan.

The Break-In service (Non-Contributory period where no contribution is paid to EPS) must be certified by the employer for 10D and 10C applications. The EPS settlement is calculated based on the average of the last 12 months' salary multiplied by the number of years of service as per Table D. If, due to a break in service, the service period becomes less than 6 months, that year is not considered for service for pension (10D and 10C) purposes. If there is a break of more than 180 days, the total service will be reduced by one year.
Many times, in the case of female members, for maternity purposes, they take leave without pay. In other cases, due to medical or other reasons, if there is a non-contributory period, it is expected to be recorded with the employer. The employer provides a certificate in the form of 10D for the non-contributory period.

Why is this asked by EPFO dept. to issue a service break certificate? Even though we have sent all non-contributory pay (NCP) days' details in the 3A form up to date 28.02.2012 and then subsequently sent them in ECR files.
If a person has been employed with us for the last 20 years or more, isn't it a straightforward task to produce his service break certificate? I believe this has become irrelevant in today's context.

My client's PF claim is rejected. The claim was submitted but rejected due to the following reasons: AS PER OFFICE RECORD, ECR NOT RECEIVED FROM 01/2018 TO 05/2018 AND ALSO NCP DAYS IS NOT GIVEN IN THE LEDGER.
In this case, what should I do? Also, EPFO requires the back certificate. Can you provide any format for this?
