If you are working with the principal employer, it should be counted on 30/31 days considering the month. If you are working with a contractor, it should be counted as 26 days. The per day cost is fixed by the labor authority, which keeps changing every six months or according to state norms.

In very simple understanding in case of workmen which is governed with minimum wages the number of days shall be 26 and others who are getting salary the number of days shall be 30

Either way, it is correct. When considering the 26-day formula, you divide the monthly gross salary by 26 days to arrive at one-day wages. In this case, the weekly off is not considered a paid day. In the other case, you divide the monthly gross salary by 30/31 days to arrive at one-day wages.
Now, if we calculate OT wages, they turn out to be less using the 30/31 days formula. Therefore, it is advisable to consider wages based on the number of days in the month, not just 26 days.

Hi,
As per employment laws, every employee will be entitled to one day off with wages after 6 continuous days of work. The working hours cannot exceed 48 hours per week. Any additional working hours will be governed by overtime rules.
Employees on permanent employment will be paid as per agreed monthly wages as per their appointment terms. Daily wagers will be paid minimum wages notified and will be paid for the additional 1 day after every 6 days of work.
The Payment of Wages Act does not differentiate between workers hired through a contractor or directly hired by the employer. The act applies universally to both.
However, the calculation of gratuity amount is based on 26 days.

Hi,
Let us be specific. Let us take June 18. An employee has worked as follows: Number of days he actually attended duty = 22 Weekly off availed (let it be Sunday) = 04 E.L availed (number of E.L days) = 01 NH availed (number of NH days) = 01 Number of days not attended duty = 02
Total days = 30 OT hours in the month = 10 hrs Suppose the salary is Rs 21,000/pm. Can one calculate correctly as per the law? Total
