I work in NIELIT, an autonomous body under the Government of India (Ministry of Electronics and Information Technology). I have been working in this organization for the last 15 months as a contractual employee with a consolidated pay. There are many centers of NIELIT all over India, but my center has fewer than 10 employees. Will I get maternity benefits? If not, is there any way to get such benefits.

(a) What are the terms and conditions of your employment?

Employee Composition at the Center

(b) How many employees on a contract basis are working in the center through your contractor, and how many regular employees are working in the center employed by CPSU?

Applicability of Labor Laws

(c) What is the position regarding the applicability of various labor laws to the contract employees working in the center?

Coverage Under the ESI Act

(d) Are contract employees covered under the ESI Act, 1948, etc.?

In addition, a question will also arise as to whether any woman employee working through a contractor in the center has been denied maternity benefits by the contractor as well as by CPSU.

Are you directly working under NIELIT? Who is your Principal Employer? Who is your Contractor? What is your consolidated salary? Are there statutory deductions like PF, ESI, PT? WHO IS PAYING SALARY? Submit your Maternity claim to your Employer without worrying about the 10 Employees requirement.

Employer will scrutinize your claim and will get back to you with proper reasons.
