Hi, I was working as a Deputy Manager in a company in Kolkata for their Retail & Restaurant division. Since December 2015, the company suffered losses in another branch of business, as communicated to the employees. This resulted in our salaries being paid late, with a gap of more than a month. We were also informed that our bonus, which was part of our CTC and deducted every month from our salary, would be paid as a single amount. Additionally, we were not provided with the leave encashment amount in January 2016. Despite these issues, most of us stayed due to our allegiance to the company. However, in March 2016, I got a better opportunity and planned to shift, which I mistakenly shared with my boss. As a result, my salary was withheld for March 2016. Frustrated, I resigned on April 1, 2016, and asked for release on April 7, 2016. Since we had agreed on a notice period of one month, I agreed to adjust my leave and amount with the remaining notice period days. Although I felt that nothing should be deducted as I was not provided a salary for two months at that time, they accepted and released me on the closing hours of April 7, 2016, after completing all handover formalities with all departments. On that day, the HR department mentioned that I would be issued the Release/Experience Letter and could collect it anytime after a week. Regarding the F&F settlement, they said by May or June 2016, I would be informed about my cheque. To date, I have received none, despite several follow-ups every month. Since last month, I have been following up for my Form-16 so that I can at least submit my ITR, but there has been no response so far. Kindly suggest a way out of this financial and mental trouble I am facing. Regards

Please consult a lawyer and send them a notice. Try to get other people along with you who are facing the same issue from the organization.

Also, please check your appointment letter for any clause related to delayed salaries.

Put up a strong case, and you can always approach the Labor court for the resolution of this issue.
