My previous employer is not paying my full and final settlement on the pretext that they haven't received the funds from the client I was working with at the time. I had served the full notice period as per the Last Working Day (LWD) mentioned in the resignation acceptance mail, and they also committed to the FnF payment at the end of 2 months after the said LWD. Now it's 1 month more than that. I have sent an email citing the current financial issues I am facing (I have had to take a loan to cover my living expenses in the interim), and all they are saying is they cannot release payment until the client pays.

Request your kind advice here as to what legal remedies I have regarding this situation. Also, will there be any repercussions for me in the future, like negative feedback from the company if I take legal action? Do I have any remedy for this as well?

Wages are your right. Follow this:

Under the Shops and Establishment Act, the employer has committed a default. Contact your city's Labor Department. They will take care of it.

Under the Payment of Wages Act, they have committed an error. Again, contact your labor department. Write an application and submit it to them.

Issue with Final Settlement Amount

My final settlement amount is very low. I worked for 20 days of my notice period, but they only paid me for 7 days. They mentioned that my resignation request was raised on August 18th and my Last Working Day (LWD) was August 25th, so only 7 days of salary will be payable. However, I sent an email to my manager on August 5th, and he accepted it on the same day. It was his fault as he raised the request only on August 18th. Unfortunately, he is no longer working in that company. What can be done? Please assist me with this matter. I don't have a copy of my resignation email.
