Navigating Termination Process: Performance Management & Legal Rights - CiteHR

Hi all,

I am Vinod, working as a Recruitment Manager in a leading Retail Co. for the past 3.5 years. Recently, our VP met with me and asked me to quit my job due to my poor performance. I have all my updated data to prove to him that my performance is up to the mark. As a company policy, they haven't given me any warning letter before asking me to leave.

I have no idea what to do at the moment. Please suggest/guide me.

As you mentioned that you are involved in recruitment, please review your appointment letter and carefully read all the clauses included in it. If there is a clause concerning termination, kindly highlight it so that I can provide you with the necessary advice.

To the best of my knowledge, all staff, except for permanent workers, can be terminated by the company with a valid reason. I have a query regarding the following points:

1. Whether the company has obtained a resignation letter from you stating that you are resigning voluntarily. If so, there is no action required.
2. If you are a confirmed employee, the company is obligated to pay one month's salary before termination.

Please take a moment to revisit the appointment order.
