I have been working in a Pvt. Ltd. company for the last five years, and I am registered with the EPFO department under the same company. I would like to know what my final compensation will be when I leave the company or if the company terminates my employment. Can you please provide information about the minimum compensation I am entitled to receive according to Indian labor laws?

Dear Sandeep,

When resigning after 5 years, your earnings will include Unpaid Salary (if applicable), Balance EL amount, Gratuity, Bonus, and Notice Pay deduction from your salary.

Upon termination after 5 years, your earnings will consist of Unpaid Salary (if applicable), Balance EL amount, Gratuity, Bonus, Retrenchment Compensation, and Notice Pay.

Hi Radhika,

I also have my UAN number and other PF contribution details. Now, my concern is what components I can claim from my employer. Can I claim Bonus and Gratuity from them? They are deducting both EPF contributions from my salary, which is illegal.

Yes, you will get your gratuity only. Bonus will be paid only during Diwali if it is an annual bonus. You will receive your PF and pension amount after leaving your organization. No, they can't deduct both contributions from your salary, as even the EPF Office will not accept that practice. Your employer will have to pay a penalty if they are doing so.
