Understanding Maternity Benefits and Employment Rights Regarding Targets During Pregnancy - CiteHR

Hi,

I am 18 months pregnant and working in the sales department where we have targets to achieve. However, in the last 2.5 months, I have not met the targets assigned to me. As a result, I have been issued a one-month notice.

I am putting in my best efforts, but the pressure is taking a toll on my health. Being pregnant, I am concerned about finding another job at this time.

I am feeling overwhelmed and unsure about what steps to take next. Can my employer terminate me if I am unable to meet the targets?

Hi,

No, they can't terminate you. The Maternity Benefit Act states that there should be no termination or notice to women workers during pregnancy. The act also specifies that pregnant women can be assigned non-tedious work upon the request of the female worker.

I suggest you ask your employer to reduce your targets to support your good health.

Dear Madam,

During pregnancy, it is not legally acceptable to terminate employment, nor can they force you to perform heavy work. If you are facing severe issues, contact a lawyer for proper guidance. Do not submit a resignation letter from your side. You may also be eligible for maternity benefits if you are exempted from ESI by your company, which includes 3 months of leave with wages (45 days before delivery and 45 days after delivery) as per the Maternity Act.

Legally, they cannot terminate you. Politely explain the problem to the company as far as targets are concerned. Refer to sections 4, 5, and 6 of the Maternity Benefits Act for better understanding. Even difficult work cannot be assigned to you in the last six weeks before delivery.

Thank you for your advice. I am now able to focus on my health and work. However, it is disheartening that many employers do not show concern for their female employees. Apart from the big MNCs, most employers do not comply with the law.
