Company Location and Employee Concerns

Company location is Bangalore. We are working from remote locations in Odisha and across pan India. This company has more than 200 employees. I have been an employee of this organization for the last 1.6 years, but now the company has put us under the loss of payment category. They have not deposited our PF and have not cleared travel claims amounting to approximately 80,000 to 90,000. When we try to contact the HR team or management, they do not respond to our emails or calls. Even all India engineers are facing the same issue. Please, can anyone help me?

Mandatory EPF Contributions and Employee Rights

It is mandatory to deduct contributions and credit them in the EPF account of an employee covered under the EPF Act. You can request information under RTI from the EPF PIO about how many employees of the company are covered under the Act, when the inspector last inspected the records of the company, and whether the number of eligible employees have been covered under the Act.

Similarly, you can ask for information or file a complaint with the inspector of the Shops and Establishment Act for non-payment of wages or TA to employees.

Thank you, Sushil. The employer has provided us with the EPF account number. All travel claims are verified, calculated by accounts, and approved by the state head and regional manager. However, when we inquire with the accounts department, they inform us that they only have data for 2014 and do not possess any previous records. HR has mentioned that the management has decided that no one should attempt to locate any previous backlogs.

RTI Act Application Process in India

The RTI Act is applicable all over India. You can request information from any Public Information Officer (PIO) under the Employees' Provident Fund (EPF) or from the PIO of Tamil Nadu shops and establishments. There is a prescribed format under the RTI rules available on the website of the Department of Personnel and Training. Pay a fee of Rs. 10 through a postal order by enclosing it with the application. Fill in the particulars in the application format and send it by registered post to the concerned PIO.

Search "RTI form download" and then download it from the NCT of Delhi site. Fill up the form, enclose a Rs. 10 postal order, and send it through speed post to the PIO of the Labour Department of Bangalore.

EPF Withdrawal Concerns

I checked the EPFO website, and my name is showing there. Establishment Id: PYBOM0046460000 TRRN: 2481411006922. As discussed with EPF office staff, the amount has not been deposited into my account. When I inquired about how to withdraw the amount, they advised me to fill out Form 19 and 10, signed by the employer. I replied that it is not possible because they do not want to deposit our PF or provide a signature. The EPF staff instructed me to send the form without a signature.

Now, I am contemplating whether it would be better to file an RTI or send the form without the signature.

Travel Allowance Recovery

Secondly, I am unsure about how to recover my TA.

Dear Sushil Sir, On the EPFO website, it shows my name with Establishment Id: PYBOM0046460000 and TRRN: 2481411006922. As discussed with the EPF office staff, the amount has not been deposited into my account. When I inquired about how to withdraw the amount, the EPF staff replied that I should fill up the form and have it signed by my employer. I mentioned that it is not possible as the office does not want to deposit our PF or provide a signature. The EPF office staff then suggested sending the form without the employer's signature. Please advise me on whether I should submit an RTI application or if there is a better course of action. Additionally, I would like to know how I can recover the TA amount. Thank you.

If you can fill out the forms properly and send them by speed post to the employer for forwarding to the EPF Authorities. Wait for 7-10 days and check with the EPF Office. If the employer has not sent it to the EPF, then file a written complaint with the EPF authorities to process it by compelling the employer to sign the forms. Seek prosecution of the employer by the EPF authorities. Send a legal notice to recover TA dues.

Dear sir,

The company is sending me the full and final settlement by mail. If you allow me, I will send you the attachment. Secondly, when we are calling them, they are charging us, stating that the company does not want to pay you anything. Can I make a complaint online regarding the non-payment of EPF and TA?

Regarding EPF dues, follow the earlier said procedure.

Regarding non-payment of other dues, as I mentioned, send a legal notice to the employer and then pursue the matter before the inspector under the Shops and Establishment Act.

Online complaints may not be feasible.
