Dear All,

Can an employee be sacked on non-performance grounds without any notice, immediately on the spot?

Case analysis: This employee is a supervisor of a small process in the production unit, and his carelessness has caused major problems in production. Can he be sent home without any notice, show-cause notice, etc.? There are lots of complaints against him for misconduct with employees, though not complained about by the workers themselves. What should be done in this situation? Please give your suggestions and opinions.

Sacking (sounds abhorrent) or Discharging on the ground of "Loss of Confidence" is only possible. It may invite long-drawn litigation. Think of suspending him pending an enquiry and immediately issue a Charge Sheet/Explanation Letter stating the precise act of misconduct this time. Hold a Domestic Enquiry, and based on the findings, give a proportionate punishment. Instant anger is no solution.

Were any actions initiated for previous acts of misconduct?
