I have been working in a Pharmaceuticals MNC company for the last four years. Recently, the company hired a new ZBM who is looking to reorganize the field force. Unfortunately, he has forcefully initiated a notice period for me, which I would like to have canceled.
Could you please advise me on the rules and regulations pertaining to this matter?
Thank you,
Ajay Kumar Yadav

I think generally in every company, there is a provision to terminate the service of an employee by giving one month, two, or three months' notice or by paying an amount in lieu thereof. You mentioned that you have been working for the last four years in an MNC pharmaceutical company. At the time of joining, did you not receive an appointment letter? If you did, was the notice period mentioned in that letter? If there is no such provision in your appointment letter, it cannot be made applicable to you with retrospective effect unless your free consent is obtained to do so.
Therefore, your newly recruited ZBM does not have the right to make any changes regarding the notice period of existing employees. If he suggests including a notice period for existing employees retroactively, it will be deemed null and void. The aggrieved person is free to seek redressal through the appropriate forum or court.
However, if the management wishes to establish this as a policy for newly recruited employees in the future, they can do so by including a clause regarding the notice period for future employees.

It is concerning that he forcefully took your resignation. How did this happen? Your inquiry suggests that there may be undisclosed information or details you are hesitant to share. Therefore, I kindly request you to provide further clarification.
Clarification on Resignation Circumstances
Could you elaborate on how he compelled you, as a longstanding employee of over four years, to resign? Did he subject you to any form of mental pressure or harassment? Have any other employees in your company been coerced to resign like you, or was this specific to your situation?
If you were the only one targeted for resignation, what sets your case apart from others? As Mr. Roa previously mentioned, the new ZBM should not act against the terms and conditions of employment established in your appointment letter four years ago. You have the right to challenge his actions, yet you seem hesitant, implying a possible issue on your end. Please shed light on this matter for further understanding.
