If an employee (basic salary greater than 10,000) resigns and serves the proper notice period, is he eligible for a bonus (Diwali Bonus is part of the C.T.C)? I am awaiting your valuable feedback. By our bonus is not covered by payment of bonus act. So it’s discretionary It’s at the wish of the company whether to give it to you or not.

Bonus Payment in India

Every employer in India should pay a bonus to employees whose basic salary is less than Rs. 10,000/-. Please tell me how the bonus of your company or any company operating in India is not covered by the Payment of Bonus Act.

If you read the original post, it very clearly states the concerned person has a basic salary above ₹10,000. Since the bonus under the Payment of Bonus Act applies only to employees with a salary below ₹10,000, the act does not apply, and the bonus is payable at the discretion of the employer.
