Query on Handling ESIC Contributions for Dual Employment

I have a query about how to handle ESIC contributions in the case where a person is working two jobs, and ESIC is applicable at both places. Can we make two contributions using one ESIC number? Kindly assist me with this if anyone has experience with such a situation. I am awaiting a response.

Employment and ESIC Regulations

A person cannot have employment at two places simultaneously. Also, ESIC is a unique number issued for the member; hence, an employee cannot have two different ESIC codes. Referring to your case, ESIC has to be considered for only one establishment.

Such situations as mentioned by the initiator of this thread are very rare in employment. However, in my opinion, action can be taken under Regulation 38 (Scheme by Joint Employers) and also under Regulation 36 (Employment for Part of a Wage Period) of the ESI (General) Regulations, 1952. Kindly also see Regulation 39 of the said Regulations.
