Just want to ask your opinion regarding these HR issues, sir/ma'am:

1. If the income earned is taxable, will it be part of the 13th-month pay computation? What if such income is not included in the computation of the 13th-month pay under CBA?

2. If a university teacher is paid hourly and his salary is expressed in days, say 100 days, will the national holidays during semesters be included in the computation of the 100 days? Or are the teachers not entitled to such national holidays?

3. Can the administrator of a school have the right to ask PRC to revoke a license if a teacher resigns within the school calendar even if such a condition is not contained in the contract?

4. Can the administrator reduce the monthly salary of a pregnant employee by changing the formula with her actual number of days rendered instead of a constant divisor?

5. For practices under litigation, can the management continue such practices?

1. Administration is reducing the salary, but what is the reason? Please specify the reason.

2. As you mentioned, she is a pregnant lady, so she will be covered under the Maternity Benefit Act and can avail 84 days of leave with a rate based on the average daily wage.

3. National holidays are paid holidays.

Thank you, sir, for giving attention to the issues at hand. According to the administrators, the pregnant lady will not work for the whole semester since she will give birth. Hence, what she received as salary, even if she had more units this semester compared to last semester, is lower. The computed salary is based on her actual days rendered before her maternity leave and not the usual days of the semester.

With regard to national holidays, the university teacher is not paid during holidays because, according to the boss, there is no actual teaching during those days. However, if there is a local holiday like city day, the boss says it's part of the 100 days; hence, we pay. I feel that there is something wrong with HR practices in this school.
