My friend left the company last year without resigning (you could say she absconded) due to severe health issues, including severe depression and stress. She is now living in her hometown and does not want to return to work. After she left her job, the company sent her a termination letter. This was five months ago, and everything was fine until recently. However, recent developments have escalated the situation. The company HR has sent a letter stating that as part of the final settlement, she needs to pay 20,000 Rs to the company, or else they will initiate legal action against her. Is that possible? Can the company take legal action against her? Please provide your valuable advice on how to tackle this situation.

What is the clause mentioned in the appointment letter regarding absconding? Did she possess a medical certificate in that context? If she is ill, why were the exit formalities not completed? If she is in possession of any valuable assets of the organization, please retrieve them and then give her notice. Why can disciplinary action not be initiated against her as per the appointment letter?
Please let me know if you need any further information in this regard.
