Claiming Leave Salary from ESIC
I am working in a manufacturing company as an HR professional. I have a case regarding claiming leave salary from ESIC. After an accident case, a worker was on ESI leave for 1 month in November. We wish to claim his leave salary from ESIC. What will be the procedure for claiming leave salary, and what documents are required for that? Is it possible to claim his leave salary considering this matter is approximately 6 months old?
Please guide me on this matter. If this is feasible, how can I calculate the total amount of leave salary?

There are many important facts that you have not disclosed in the thread you started. It is not mentioned whether, in respect of the accident that occurred, the principal employer has submitted any accident report to the appropriate branch office of ESIC. Whether the said accident occurred in the course and out of employment, and whether it was admitted as an employment injury by the ESIC branch.
Whether the worker/insured person in question visited and examined himself in the ESI dispensary or ESI Hospital to claim medical facilities. If so, whether the ESI Institutions issued any medical certificates. If yes, the worker/insured person can contact the appropriate ESIC branch office to claim benefits under the Act.
Understanding Benefits Under the ESI Act, 1948
Under the ESI Act, 1948, benefits for covered employees are known as cash benefits, medical benefits, temporary/permanent disablement benefits, etc., and not as "Leave Salary" as you mentioned. If due, the benefits should be claimed directly by the concerned employee/insured person from ESIC, not by the employer.
