I did not receive the Form 16 from my current employer, even though the company has deducted tax from my salary. I have checked online on the Income Tax site, and it shows that the tax is entered in my account. I have written a few emails to the accounts manager, but she has not responded to any of my emails. What should I do in such a situation?

When did you join your current employer? Please share your date of joining first, as it will help you in getting a proper response. If you joined them in the current financial year 2013-14 (Assessment Year 2014-15) or after April 2013, you will receive your Form 16 next year after the completion of FY13-14 (by March 2014 or as soon as the computation is done by the employer for the respective period). However, you can find the deduction details in your salary slip every month.

For example, in your current month's salary slip, you can notice the deducted amount (if/as applicable).

Further Information About Form 16

At the end of the financial year, the company/employer issues a Form 16 to an employee, which contains details about the salary earned by the employee and how much tax has been deducted, including details of the deducted tax for each month from April to March.

Lastly, there is no need to worry because Form 16 is actually a statement providing details about the tax deducted by the employer on behalf of the employee. The same amount will be paid to the government by the company, so they are required to provide Form 16 to the respective employee.

I joined them in January 2012 and received the Form 16 for the last financial year 2011-2012. However, I haven't received it for the financial year 2012-2013. I need to apply for a home loan. How should I do that? How can I file my income tax returns without Form 16?

For 2012-13, how did you file your IT RETURN.? In the income tax site or through your bank, you can get a copy of form 26 AS, which will show details of tax deducted and remitted

Whether your tax is deducted or not, if an employee asks for Form 16, Accounts/Taxation dept is bound to give him the same. It is a right of an employee.

Nowadays, filing of IT returns is done online, where Form 16 is not required as mentioned by other members. Form 26AS is sufficient to match the TDS deducted. For a home loan, a copy of the IT return is sufficient. In case the IT return is not available, Form 26AS along with your Statement of Income will suffice the banker's requirement. You may need to consult a senior person at the bank as the sales representative might not provide proper guidance.

The above does not state that the employer should not give you Form 16; they are obligated to provide it. Consider sending a letter to the HR/CFO/Director for assistance in resolving your issue.
