Hi Friends, Please clarify for me whether any contractor without a registered office in Jammu faces any restrictions in obtaining a code.

Provision for PF Deduction for J & K Contractual Workers

Also, could you inform me if there is a provision to deduct PF for J & K contractual workers anywhere in India? If possible, please provide me with the Manual of PF Act J & K.

As rightly answered by Varghese Ji, the provisions of the EPF & MP Act 1952 do not apply to J&K. However, in J&K, a similar enactment exists to my knowledge. You are requested to go through it. In this forum, you may not get much information on it. Any member of this forum aware of the enactment in J&K is requested to share.

Thank you for your valuable feedback. I have one more query: if we are remitting the existing contribution in EPFO, is it feasible to transfer the contribution to the J&K PF department? Please clarify.

As rightly answered by Varghese ji, the provisions of the EPF & MP Act 1952 do not apply to J & K. However, in J & K, a similar enactment exists to my knowledge, i.e., "The Jammu and Kashmir Employees Provident Fund Act, 1961." You should apply for registration under the provisions of The Jammu and Kashmir Employees' Provident Funds Act, 1961 at Jammu, and deductions should be made accordingly. The contribution of PF for J & K contractual workers shall be deposited at Jammu and Kashmir only.

EPF Scheme Transfers

The EPF scheme paragraph 57 allows only transfers from one account to another within the same scheme or to an exempted establishment having its own fund. For the query of Mr. Krishnaprasad, the authorities under the J&K Act are to be consulted.

In Jammu and Kashmir, there is another PF Act and scheme applicable called The Jammu and Kashmir Employees Provident Fund Act, 1961, and Scheme 1961. Every establishment with 10 or more employees needs to obtain a PF code (w.e.f 25 Oct 12). Pension contributions are included in the scheme, with 12% to be deducted and submitted—6% from the employee and 6% from the employer.

Dear All we have taken PF code in Himachal Pradesh under EPF & MP Act, 1952, now we have opened branch office in J&K. so do we need to apply for separate code there under J&K EPF&MP Act, 1961??
