I am working in a startup company for the past year, and I have submitted my resignation, which they have accepted. I have also completed my notice period. However, the management is now not providing my salary and the necessary documents. How can I join another company without these documents? I need some help from senior management.

Thank you,
Mr. Nanki Rao

Dear Mr. Nanki Rao,

Clarification on Resignation and Notice Period

This type of query has been raised many times on this forum. Our team members have also provided enough replies on the same. However, the originators of such queries don’t present clear pictures about their cases. Because of this, members presume different situations and answer accordingly.

In this cited case, you have not clarified the terms of your appointment. Simply accepting a resignation letter does not mean that you have fulfilled all the terms of your appointment. For instance, in your case (again, an assumption without clarification), if the notice period is three months, how can the company relieve you and provide all the dues and papers within one month?

Considerations for Company and Employee Relations

It is also pertinent to note how your company might feel, having incurred recruitment and training expenses on you. Just as they are ready to benefit from your skills and knowledge, you are parting ways with the organization. However, in many cases, situations arise where changing organizations becomes necessary. In these cases, employees must exhibit behavior that allows for an easy separation from the current company.

Advice for Transitioning Between Organizations

Before committing to a new organization regarding the joining period, clarify your notice period in the current organization. Failing to do so can leave us in a standstill—unable to stay in the present organization or join the new one. Always maintain good relations; at some point, one might need the organizations they left.

My heartfelt advice to startups: avoid making decisions hastily.

With Best Wishes.

Hi Bharadwaj,

I have been relieved and received a relieving letter from the company. However, they have not paid my last month's salary or provided an experience letter. The HR representative mentioned that I may receive a red mark during verification.

Please advise me on what to do.
