Request suggestions on my query. My brother has completed Hotel Management and was working at a well-known company's restaurant in Mumbai. However, the company's headquarters were in Delhi. He worked there for around 2 years and resigned due to some salary issues.
Later, this company was acquired by another beverage company. Now, after one year of leaving the company, we attempted to apply for his PF withdrawal. We tried to obtain the employer's signature but were unsuccessful. In fact, the HR of the new company was uncooperative.
Therefore, we directly sent the forms to the Delhi office with an application detailing all the reasons. However, the office returned the forms, stating that they needed to be signed by the employer, despite my clear mention that we were unable to obtain the employer's signature.
In this situation, please advise on what steps we should take, as the amount of PF involved is substantial.
Please kindly assist us.

We can apply directly without taking the employer's signature. The only thing you need to do is get a signature from one of the following officials:
1. Any Nationalized Bank Manager (Preferably SBI)
2. District Magistrate
3. Provident Fund Commissioner
Along with the PF claim form, you need to submit an affidavit stating the reasons for not being able to obtain a signature from your past employer.

Please get the form signed by any of the persons mentioned in the instructions of Form 10 C (attached herewith). If none is signing, get it attested by a public notary. There is no need for an affidavit as per my knowledge. Just attach any proof of identity and a canceled cheque from the bank in which you need your money to be transferred. The cheque must contain the IFSC code of the bank. Also, attach a copy of any proof of employment (such as an ID card, salary slip, appointment letter) and address your letter to the Provident Fund Commissioner.
