It's been 50 days since I joined my service provider company. I provided them with my documents for the procurement of a Tata Indicom connection for the office without any questions and had them write a letter stating no risk/liability for the same. However, they haven't given me my appointment letter yet, nor my salary for the first month. They are not granting me leaves when urgently needed, which was only for one day.

I am an English and IELTS instructor, but they have me serving water for seniors when I am free. Additionally, they make me call hundreds of numbers and generate sales for their course, which is not within my profile, but I do it thinking that I'll learn new things.

Seeking Advice on Job Continuation

What should I do? I am also pursuing M.Com and require at least 2-3 days of leave in a month. During the appointment interview, they promised to provide me with an assistant so that there are no issues when I am on leave. Should I continue with this job?

Did they provide any appointment letter? What is mentioned in that? If you are unhappy and feel they are using you, then you can start looking for another job. In case you can afford it, concentrate on your studies and try to achieve a high percentage.

Make it very clear that this is not within your job profile. First, ask for an appointment letter; otherwise, inform them that you will not be coming from the next day. Also, inquire about your salary.

Normally, in the majority of small companies, appointment letters, confirmation letters, etc., are issued very late, or sometimes not at all. However, they will adhere to whatever they communicated to you during your joining or interview.

If you are dissatisfied with their work practices or feel that you are being taken advantage of, please express your concerns to your immediate boss, HR, or management. If you continue to work without voicing your opinions, they may assume that you are willing to accept any tasks assigned to you.

It might be beneficial for you to update your resume on job portals and explore other job opportunities.

I am afraid that I won't get paid for the 50 days I have worked here. I have witnessed many disputes between my branch head and the carpenters and advertisers who come for their dues. I don't have an appointment letter, and they can ask me to leave the company without paying my dues. I know this because I have seen them do it to others. During the interview, the boss told me that I would be provided with an assistant and that I would receive the appointment letter within a week. He also mentioned that I would be the center head, but that is not the case. He promised that I would receive my private visiting cards. However, now when I ask for these things, he simply says, "Dekhte hain."

There are so many things going wrong and appearing suspicious and shady. Why did they ask you to provide your own personal documents for an office telephone connection? In this phone, several and frequent business calls are being made, and it will surely run up a huge bill. What if the company refuses to pay the bill? As per your letter, the company has no liability or risk! So, you end up paying the bills or being sued for it! Please get out of this exploitative situation as fast as you can.

No, sir, I got the letter stating no risk and no liability for my name. I have used the company's notepad where its name and address are written. Then, I got it signed by the branch head or director (I am not clear which he is), and the phone usage is at a moderate level. But anyway, I have made up my mind to leave the job.

Dear Nevia, I appreciate that you have discussed before taking any step forward. If you have decided to leave the organization, then you can take a bold step to get your documents and salary back.

Steps to Take for Document and Salary Retrieval

Please read carefully and take all the first three steps in one day only with top secrecy from your current organization because if this came to their knowledge, they will create a criminal case against you. I have seen many cases of this kind.

1.0 You must take a copy of attendance records and other records, whatsoever it is, to prove yourself an employee of that company.

2.0 Visit your nearest labor commissioner and submit your complaint in writing to him as well as to the local SP's office.

3.0 You must go for an FIR directly from the SP office for your salary and documents.

4.0 As a professional, you must resign instead of getting absconded because I understand where you are currently working and what situation will arise if you leave the organization without resigning.

5.0 After step 3.0, you must hand over the charge (office assets or whatever you have) in front of a legally valid officer.

Further to your response, I agree with the steps suggested by Sumit. In fact, I would have suggested similar steps as the situation you are in is highly abnormal and appears shady. Please do not accept the company's assurance at face value, as you have already seen how they have defaulted on their assurances.
